General Terms and Conditions of Sale of PAUL MARIUS Gift Cards to Individuals

Preamble - Definition

In this document, the following terms shall have the meanings set forth below: "BENEFICIARY" refers to any natural person holding a GIFT CARD

• "SHOP" refers to a physical boutique under the name "PAUL MARIUS" offering the PRODUCTS for sale
• "GIFT CARD(S)" refers to the material medium (in the form of a plastic card) or dematerialized medium (in electronic form) of a prepaid account domiciled in the usual bank account of PAUL MARIUS GIFT CARD, a medium on which appears a unique bar code and which constitutes a purchase voucher for the benefit of the RECIPIENT, for any order of PRODUCT made by the latter on the SITE or in the SHOP.
• "GTC Gift Cards" means the present general terms and conditions of sale.
• "PAUL MARIUS" means the general terms and conditions of sale of the PRODUCTS on the SITE, which can be consulted by clicking on the following link: https://www.paulmarius.fr/terms-conditions
• "PERSONAL DATA" refers to the list of surnames, first names, postal addresses, e-mail addresses, dates of birth, and civil status of SUBSCRIBERS and BENEFICIARIES.
• "PAUL MARIUS GIFT CARDS" refers to the company FPPM International, registered in the Rouen Trade and Companies Register under the number 537 749 095, whose registered office is located at 91 rue Méridienne - 76100 Rouen, which offers PRODUCTS and GIFT CARDS for sale to consumers, whether in the SHOP or on the WEBSITE; as well as the independent dealers of the PAUL MARIUS network operating a SHOP and having chosen to join the GIFT CARD program, the list of which can be consulted by clicking on the following link https://www. paulmarius.fr/our-shops
• "PRODUCTS" refers to all the products offered for sale in the SHOP or on the WEBSITE by PAUL MARIUS GIFT CARDS.
• "SITE" refers to the PAUL MARIUS CARTES CADEAUX Internet site accessible via the address: https://www.paulmarius.com
• "SUBSCRIBER" refers to the natural person who purchases a GIFT CARD in the SHOP or on the SITE for the benefit of a RECIPIENT.

Article 1 - Purpose

The present GTCS GIFT CARDS govern the purchase of GIFT CARDS by the SUBSCRIBER from PAUL MARIUS GIFT CARDS in the SHOP or via the WEBSITE, as well as the use that will be made by the SUBSCRIBER of the GIFT CARD(S) thus purchased.

Any purchase of a GIFT CARD implies the SUBSCRIBER's unreserved acceptance of the entirety of these GIFT CARD GTCs, as well as of the PAUL MARIUS GTCs if he or she makes the said purchase via the SITE or in the PAUL MARIUS boutiques.

The SUBSCRIBER declares in this respect that he/she has the legal capacity to contract, thus enabling him/her to make a purchase from PAUL MARIUS GIFT CARDS, whether in the SHOP or on the SITE. However, if the SUBSCRIBER is a minor, he/she declares that he/she can only purchase a GIFT CARD on the WEBSITE if he/she has obtained his/her parents' (or guardians') prior consent.

PAUL MARIUS GIFT CARDS reserves the right to make changes to the GIFT CARDS T&Cs, the latest version of which can be consulted on the SITE by clicking on the following link: www.paulmarius.fr/terms-conditions-gift-cards 

The GIFT CARD GTCS applicable to any purchase of a GIFT CARD are those in force at the time of the subscription of the purchase of the GIFT CARD by the SUBSCRIBER via the SITE. Consequently, any subscription of the purchase of the GIFT CARD by the SUBSCRIBER via the WEBSITE after modification of the GIFT CARD GTCS implies full and complete acceptance of the said GIFT CARD GTCs in their new version.

Article 2 - Purpose and use of the gift card

2.1 : Destination of the GIFT CARD

The GIFT CARD is exclusively intended to allow the BENEFICIARY who is the bearer to make, by means of this card, the partial or, if necessary, total payment of the purchase of one or more PRODUCT(S) on the WEBSITE or in one of the SHOPS of the country where it has been subscribed, by using a unique bar code appearing on the support. The amounts proposed for the subscription of the GIFT CARD are: twenty (20) - thirty (30) - fifty (50) - seventy (70) and one hundred (100) euros. The GIFT CARDS are electronic money products that are not subject to VAT.

The GIFT CARD is exclusively intended for consumers. The SUBSCRIBER and the RECIPIENT are prohibited from reselling the GIFT CARD, transferring it for a consideration or exchanging it for cash. PAUL MARIUS GIFT CARDS reserves the right to definitively deactivate any GIFT CARD that is used in violation of the present provisions, without the SUBSCRIBER and/or the BENEFICIARY being able to claim any reimbursement and/or compensation for this.

2.2 : Right of withdrawal

In accordance with the articles L. 221-18 and following of the Code of the Consumption, the SUBSCRIBER benefits, in case of purchase of the GIFT CARD via the WEBSITE, of a period of thirty (30) working days running as from the day after the reception of the GIFT CARD to exercise his right of retractation without having to justify reasons nor to pay penalties. This right of withdrawal may be exercised provided that the GIFT CARD concerned has not been used, partially or totally, by the RECIPIENT to pay for a purchase of a PRODUCT on the WEBSITE or in the SHOP. To exercise his right of withdrawal, the SUBSCRIBER must notify his decision to withdraw from his order within the time limit indicated above in writing, by any means and in particular

Via his Customer Space, by clicking on the heading "My Account" / "My Orders" and by clicking on "Make a return" on the line of the order corresponding to the purchase of the Gift Card
Or by returning to us, at the postal address indicated, the retraction form at the bottom of these GTC Gift Cards completed and signed.

Following receipt of this request for withdrawal, PAUL MARIUS GIFT CARDS, in accordance with the legal provisions, will reimburse the SUBSCRIBER within 14 days following notification of the request for withdrawal. Any request for withdrawal received after the aforementioned period of fourteen (14) working days shall not be honored.

2.3 : Conditions of transmission of the GIFT CARD to a BENEFICIARY

The transfer of ownership of the GIFT CARD is made from PAUL MARIUS GIFT CARDS to the SUBSCRIBER at the time of its purchase by the SUBSCRIBER, materialised by its activation by the staff of the SHOP (in the case of purchase in the SHOP) or by the sending of the GIFT CARD to the SUBSCRIBER in the case of purchase via the WEBSITE. The SUBSCRIBER is then entirely responsible for the transmission of the GIFT CARD to the RECIPIENT, a third party of his choice, whom he will have to inform of the conditions of use of the GIFT CARD described in the present GTCS GIFT CARDS, which the RECIPIENT is considered to have accepted in full and without reservation by the simple fact of this transmission. The SUBSCRIBER and the RECIPIENT will then bear the entire responsibility for the conservation of the GIFT CARD, PAUL MARIUS GIFT CARDS not being able to be held responsible in any case in case of error by the RECIPIENT, of loss or theft of the GIFT CARD medium with its bar code, or of fraudulent use of the GIFT CARD by a third party.

 

2.4 : Use of the GIFT CARD

 

a. Territorial validity The GIFT CARD can only be used to purchase PRODUCTS on the WEBSITE www.paulmarius.fr or in SHOPS located on French territory (list available on the WEBSITE by clicking on the following link: https://www.paulmarius.fr/nosboutiques.html if it was purchased via the WEBSITE or in a SHOP located on French territory. The GIFT CARD can only be used to purchase PRODUCTS on the WEBSITE www.paulmarius.fr or in SHOPS located on Belgian territory (list available on the WEBSITE by clicking on the following link: https://www.paulmarius.fr/nosboutiques.html if it has been subscribed in a SHOP located on Belgian territory.

b. The validity period of a GIFT CARD is twelve (12) months as of its purchase by the SUBSCRIBER. The validity date must be indicated on the Gift Card's medium or, failing that, the date may be obtained by the SUBSCRIBER or the RECIPIENT:

After the validity period, the expired GIFT CARDS are closed and the unused balance is definitively lost.

 

c. Terms of Payment for PRODUCT purchases with the GIFT CARD:

The payment of PRODUCTS by the RECIPIENT by means of the GIFT CARD may be made up to the amount of the GIFT CARD, until the balance of the card is exhausted or its validity has expired. Under no circumstances may the remaining balance of the GIFT CARD be exchanged or refunded to the BENEFICIARY or the SUBSCRIBER.

When using the GIFT CARD to make a purchase of a PRODUCT on the SITE, the BENEFICIARY will not have the possibility to determine himself the amount of the credit used. Thus, in the event that the total amount of the purchases is greater than or equal to the available balance of the GIFT CARD, this balance shall be fully used and the BENEFICIARY shall then pay the possible remainder with another payment method. In the event that the total amount of the BENEFICIARY's purchases is less than the available balance of the GIFT CARD, the total amount of the purchase will have to be paid with the GIFT CARD which will be, at the end of the transaction, always credited with the balance of the difference between the amount of the purchase and the original balance of the card.

Ex: Total amount of the purchase on the SITE: 20 euros including VAT
Credit on the GIFT CARD: 30 euros

The BENEFICIARY will not be able to choose to use only 10 on the GIFT CARD and to pay 10 euros by credit card. The entire purchase will necessarily be paid through the GIFT CARD whose remaining credit, after purchase, will be 10 euros.

Any purchase of a PRODUCT via the SITE by means of the GIFT CARD by the RECIPIENT is also governed by the PAUL MARIUS GTC, the latest version of which can be consulted on the SITE by clicking on the following link: https://www.paulmarius.fr/cgv.html. The prices of the PRODUCTS displayed on the SITE and in the SHOP are indicated by default in euros and inclusive of all charges, excluding shipping costs, the price of certain packaging or the price of other optional services subscribed to by the BENEFICIARY, which remain extra. PAUL MARIUS CARTES CADEAUX reserves the right to modify the prices at any time. The current price is the one applicable on the day of the order. The invoice is made out in the name of the BENEFICIARY (name, address) and is issued upon validation of the purchase by the latter. For a purchase of a PRODUCT made on the SITE, the invoice is available and downloadable on the Customer Space of the BENEFICIARY. For a purchase in the SHOP,
it will be given to the BENEFICIARY on paper. The BENEFICIARY who makes a purchase via the WEBSITE or in the SHOP, in whole or in part, using a GIFT CARD, undertakes to keep the material support for a period of 30 (thirty) days following the date of this purchase. During the aforementioned retention period, the BENEFICIARY agrees to communicate to

PAUL MARIUS GIFT CARD, at PAUL MARIUS GIFT CARD's first request, the said material support, in order to enable PAUL MARIUS GIFT CARD to verify the integrity of the purchase operation carried out by the BENEFICIARY by means of the GIFT CARD.

PAUL MARIUS GIFT CARDS reserves the right to claim from the BENEFICIARY the reimbursement of the value of the GIFT CARD by means of which he made his purchase if the BENEFICIARY is unable to produce the material support at the first request made by PAUL MARIUS GIFT CARDS during the aforementioned 30 (thirty) day retention period, or, failing this, if he is unable to communicate to PAUL MARIUS GIFT CARDS the details of the SUBSCRIBER of the GIFT CARD in question, from whom such a verification may be carried out.

The purchase of GIFT CARDS cannot be made with GIFT CARDS.

 

d. Return Policy for a PRODUCT purchased with a GIFT CARD

(i) Achat effectué sur le SITE

 

Case 1: Return for exchange

If the PRODUCT reference desired by the BENEFICIARY is of equivalent value to that of the returned PRODUCT, a standard exchange shall be made.
In case the PRODUCT reference desired by the BENEFICIARY is more expensive than the returned PRODUCT, the difference shall be paid by the BENEFICIARY.
In the event that the PRODUCT reference desired by the RECIPIENT is less expensive than the returned PRODUCT, the GIFT CARD used in the initial purchase shall be credited again with the amount of the difference, within the limit of the initial credit of the GIFT CARD used in the purchase. In the event of a remaining balance, a refund of the remaining amount will be made by the same additional payment method used for the purchase.

Case 2: Return for refund

In the event that the BENEFICIARY wishes to return a purchase paid in full by a GIFT CARD, the GIFT CARD used for the purchase will be re-credited.
In the event that the BENEFICIARY wishes to return a purchase paid for in part by a GIFT CARD, the GIFT CARD shall be re-credited with the amount of the value of the PRODUCT(S) returned within the limit of the initial credit of the latter, and then the remaining amount shall be reimbursed by the same means of payment as for the initial purchase.

Ex: The BENEFICIARY makes a purchase of 2 PRODUCTS for a total amount of 100 euros and pays with his gift card of 30 euros completed by a CB payment of 70 euros.

If the BENEFICIARY decides to return one of the two PRODUCTS, worth 50 euros, his or her GIFT CARD will be re-credited, up to a limit of 30 euros, and the difference (20 euros) will be reimbursed to the credit card used for the purchase.

Any return resulting in a re-credit of a GIFT CARD will result in the sending of an e-mail to the RECIPIENT containing a .pdf file with the bar code of the GIFT CARD attached, to allow its use, even if the RECIPIENT no longer has the material support of the GIFT CARD.

 

(ii) In-store purchases

Our terms and conditions of sale in the SHOP provide that a purchase made in the SHOP can be returned for exchange during thirty (30) working days after
purchase.

Case 1 : Return for exchange

In case the PRODUCT reference desired by the BENEFICIARY is of equivalent value to the returned PRODUCT, a standard exchange will be made.
In case the PRODUCT reference desired by the BENEFICIARY is more expensive than the returned PRODUCT, the difference shall be paid by the BENEFICIARY.
In case the PRODUCT reference desired by the BENEFICIARY is cheaper than the returned PRODUCT, a credit note for the amount of the difference will be issued to the BENEFICIARY. This credit note will be valid for one (1) year only in the SHOP where it was issued.

Case 2: Return for credit

In case the BENEFICIARY does not wish to proceed immediately to an exchange, a credit note for the amount of the returned PRODUCT will be issued. This credit note will be valid for one (1) year only in the issuing store.

ARTICLE 3 - Personal data, data processing and freedom

 

PAUL MARIUS GIFT CARDS is the owner of all the PERSONAL DATA transmitted by the SUBSCRIBER and the RECIPIENT when using the service related to the GIFT CARD. This information may be used for commercial purposes.

In this respect, in its capacity as data controller, PAUL MARIUS GIFT CARDS undertakes to comply with the legal provisions applicable to the computerized processing of personal data and, in particular, with the obligations laid down by the French law n°78-17 "Informatique et Liberté".
